Terms and conditions of use

Casalino, a SAS with share capital of €5,000, registered with the Paris Trade and Companies Register under number 802 519 595, whose head office is located at 12, place des Victoires 75002 Paris, (hereinafter "Casalino") offers a selection of properties for seasonal rental or sale in France. As such, it is the holder of a professional license to carry out real estate and business transactions, issued by the Paris Chamber of Commerce on 16/02/2023.

In this context, Casalino publishes the website https://www.Casalino.fr/ (hereinafter referred to as "theSite"), which enables anyone accessing the Site directly or indirectly (hereinafter referred to as the "User(s)") to learn more about the services offered by Casalino.

The present Terms and Conditions of Use detail the rules applicable to access and use of the Site.

Use of the Site is subject to careful reading and prior acceptance of these Terms of Use, which all Users undertake to respect.

1. Purpose  

The GCU set out the rules applicable to access and use of the Site.

 

2. Acceptance of T&Cs

 

The GCU govern all relations between Casalino and any User, who expressly accepts the terms of the GCU and has read the Legal Notice accessible via the link below: https://www.casalino.fr/mentions-legales

 

Reading and unreserved acceptance of the GCU is imperative and conditions access to and use of the Site.

 

The User acknowledges the GCU by clicking on the "General Terms of Use" tab at the bottom of each page of the Site.

 

By accessing and/or using the Site for the first time, the User acknowledges having read and expressly accepted the GCU, and undertakes to comply with its terms.

 

3. Duration of the GCU

 

These GCU are concluded, following their acceptance, for the entire duration of use of the Site, unless otherwise provided in the GCU.

 

4. Modification of the GTCU

 

Casalino reserves the right, at any time, to make any changes to the GCU that it deems necessary and useful, in particular to adapt to changes in regulations, legislation and case law, as well as to changes in the Site and the services offered therein.

 

Casalino undertakes to inform Users as soon as possible on the first page of the Site or at the e-mail address provided by the User.

If the User continues to use the Site after the entry into force of the modifications to the GCU, he irrevocably accepts the modified GCU. If the User does not agree to the amended or supplemented GCU, he/she has the sole option of no longer accessing or using the Site.

 

The GCU applicable are those in force at the time of browsing the Site, unless expressly provided otherwise by law.

 

5. Conditions of access to the Site

The Site is accessible to any User with the legal capacity to subscribe to the present GTU.

 

To access the Site, the User must ensure that he/she has the necessary technical and telecommunications resources (computers, software, telecommunications resources, etc.), in particular broadband Internet access and a suitable access terminal (computers, smartphones, tablets, etc.). These resources are the sole responsibility of the User, as are the costs incurred by their use.

 

It is the User's responsibility to ensure that the IT and transmission resources at his disposal are able to adapt to changes in the Site.

 

6. Products/services offered on the Site

 

The Site enables Users to use/benefit from all the services and information offered on the Site.

In particular, the Site aims to enable Users to:

- learn about Casalino's activities and services offered on the Site;

- send a reservation request for one of the properties presented on theSite;

- subscribe to the Casalino newsletter;

- to contact the Casalino team.

 

7. Your behaviour/your commitments and responsibility as a User

The User undertakes to comply with the provisions of the present article.

 

7.1 Behavior and commitments

 

The User undertakes to comply with the laws and regulations in force and with the GCU throughout their duration.

The User undertakes to access and use the Site in good faith and in a reasonable manner.

In addition, by using the Site, the User agrees not to:

- disrupt or interrupt access to or the operation of the Site or the servers or networks connected to the Site, or violate the requirements, procedures, rules or regulations of the networks/tools connected to the Site;

- attempt to damage any user, host or network, including, but not limited to, intentionally or negligently exposing theSite to a virus, creating a saturation point or flooding the server;

- attempt to access data not intended for the User or to enter a server/account to which the User does not have access;

- attempt to probe, scan or test the vulnerability of a system or network, or to breach security or authentication measures without proper authorization;

- usurp the identity of another person or the identifiers of another person/User;

- carry out an activity or incite a third party to carry out an illegal activity or any other activity that would infringe the rights of Casalino, its partners, its investors, its customers or any other User;

- transmit or transfer (by any means whatsoever) any information or software derived from the Site, in particular to any person not expressly authorized by Casalino and/or in violation of any applicable national or international law or regulation.

 

The User is solely responsible for providing the information requested on the Site and required to access certain services, in particular newsletter registration.

 

The User guarantees that the data he/she provides on the Site is accurate and true, and undertakes to inform Casalino of any updates to his/her data.

 

7.2 Responsibility of the User

 

The User is solely responsible for the proper functioning of his/her computer equipment and Internet access.

 

The User is personally responsible for setting up the computer and telecommunications resources required to access the Site and for acquiring the knowledge necessary to use the Internet and to access the Site.

 

The User acknowledges that he/she has checked that the computer configuration he/she is using is virus-free and in perfect working order. The User undertakes to implement all means or procedures to ensure the security of the hardware and software enabling him/her to use the Site.

 

The User is solely responsible for the use of the Site and all activities carried out while browsing the Site. The User is solely responsible for the use of all content (including, but not limited to, all graphics, images, photos, drawings, maps, plans, logos, names, trademarks, texts, information and other documentation, databases).

Furthermore, Users are solely responsible for the quality, lawfulness and relevance of the data, declarations and content they transmit/make for the purposes and in the context of using the Site.

 

In particular, the User declares and confirms that he is solely responsible for the use he makes of his data, and for any damage that may result from improper use.

 

 

7.3 Consequences

 

In general, unless expressly provided otherwise, at any time and for any reason whatsoever, Casalino may implement any means to terminate, without notice in case of serious breach, a User's use of the Site as the case may be, for any conduct violating these TOU, the law or the rights of a third party without prejudice to any damages that Casalino reserves the right to claim in case of non-compliance with these TOU.

 

The User agrees to indemnify, hold harmless and hold Casalino (and its officers, directors, agents, subsidiaries, joint ventures, employees and third party service providers involved in accessing and using the Site) harmless from and against any and all claims, complaints, demands, damages (direct and indirect) of every kind and class, known and unknown, including reasonable attorneys' fees, resulting from the User's breach of the TOU, any law or the rights of any third party.

 

8 Obligations and responsibilities of Casalino

 

In addition to its other obligations under the GTU, Casalino undertakes to comply with the provisions of this article.

 

Casalino will do its utmost, subject to any technical or service difficulties or interruptions, to ensure that the Site remains accessible.

 

Casalino cannot guarantee absolute availability and accessibility, given the nature and complexity of the Internet network and the technical elements that make it up. The User declares that he/she is aware of the characteristics and limits of the Internet, in particular its technical performance, response times for consulting or sending data and the risks associated with the security of communications.

 

The operation of the Site may be temporarily interrupted, including in the event of force majeure, scheduled or unscheduled maintenance, technical updates or improvements, emergency repairs to the Site, to change its content and/or presentation, or due to circumstances beyond Casalino's control.

 

Casalino undertakes to take all reasonable measures to limit such disruptions, insofar as they are directly and exclusively attributable to Casalino and/or the consequences thereof. In the event of a planned interruption, this will be notified by means of a warning on the Site's home page or by any other means.

 

Casalino is not responsible if Users are unable to connect to all or part of the Site due to disruption of telecommunications providers, network congestion or a failure in the User's installations and equipment, it being recalled that the User alone chooses the operator, provider of access to the Internet network.

 

Casalino makes its best efforts, with regard to the state of the art and applicable regulations, to secure the Site and the data processing carried out through its use.

 

9. Intellectual property

 

9.1 Casalino elements

 

These GCU do not imply any transfer of any kind of intellectual property rights to any content included or accessible on and/or through the Site, in particular any graphics, images, photos, drawings, maps, logos, names, trademarks, texts and other documentation.

 

All content available on the site and identified as belonging to Casalino are, unless otherwise stated, the exclusive property of Casalino.

 

All other photographs not identified as the exclusive property of Casalino that may be consulted on the site are done so with the consent of the owners of the goods shown in said photographs.

 

Any reproduction or use without the prior and express authorization of Casalino is strictly forbidden. Any unauthorized use of this content constitutes an act of counterfeiting and is punishable under the French Intellectual Property Code and may result in legal action.

 

9.2 Hyperlinks/external sources

 

The Site may include links to other websites or other Internet sources.

 

If Casalino operates one of these sites or Internet sources, Casalino will be responsible for compliance with the commitments made under the terms and conditions of use specific to the said external sites/sources.

 

In all other cases, insofar as Casalino cannot control these sites and external sources, it cannot be held responsible for the availability of these sites and external sources, and cannot be held responsible in any way for the content, advertising, products, services or any other information or data available on or from these sites or external sources, in particular as regards their topicality, completeness and absence of errors. It is the User's responsibility to make any necessary checks.

 

In addition, Casalino shall not be liable for any damages or losses, actual or alleged, arising out of or in connection with the use of or reliance on any content, goods or services available on such external sites or sources that it does not operate.

 

Any creation of links to theSite is subject to the prior and express authorization of Casalino, which may be revoked at any time at its sole discretion. Casalino reserves the right to (i) request the removal of any link to the Site that has not been, or is no longer, authorized and (ii) claim damages for any loss suffered as a result.

10. Transfer

Casalino reserves the right to transfer to any company of its choice all or part of the rights and obligations arising between the User and Casalino under these GCU and will inform the User in advance in accordance with applicable law.

 

11. Evidence agreement

Electronic documents exchanged by electronic means between Casalino and the User are considered to be written documents with the same value as the original within the meaning of article 1366 of the French Civil Code. They may constitute faithful and durable copies within the meaning of article 1379 of the French Civil Code, and the User is therefore invited to keep them.

12. Non-waiver and independence of clauses

Casalino's failure to exercise any or all of its rights with respect to a User under these TOU shall not constitute a waiver of any subsequent exercise of such rights.

 

If any of the clauses of the GCU should be declared null and void or inapplicable for any reason whatsoever, the other clauses shall nevertheless remain in force.

13. Applicable law and jurisdiction

The validity, interpretation and execution of the GCU are governed by French law.

 

Any dispute that cannot be settled amicably will be referred to the competent court.
